Our brief with the Indiana Court of Appeals was filed on October 22.


We and our attorneys are extremely confident in our legal arguments. We believe the Hendricks County trial court committed reversible error, and our appellate brief lays out the legal basis for our position.


We encourage all supporters of this movement to read the brief by visiting the Indiana MyCase portal and searching case number 26A-PL-02460. The case summary entry dated October 23, 2026, includes a PDF copy of the brief.


Given the timing around the holidays, we would not be surprised if David Weekley requests a 30-day extension, which, if granted, would push the timeline for this case into late December. After their response, we will be given an opportunity for a final reply.


Our case was dismissed on a procedural issue without a judge ever reviewing the merits of our arguments or the validity of the Brownsburg APC’s approval. We strongly believe our community's concerns deserve a fair hearing on the actual facts, and we remain fully committed to seeing this process through.
